«Противодействие экстремистской деятельности и проблемы соблюдения конституционного права граждан на свободу вероисповедания в регионах России»

Для участия в круглом столе приглашены представители Администрации Президента РФ, подразделений, отвечающих за борьбу с экстремизмом в МВД и Генеральной прокуратуре РФ, ученые, представители религиозных объединений из регионов России, где церкви сталкиваются с серьезными проблемами.

Участниками и ведущими круглого стола также будут:

- Анатолий Васильевич Пчелинцев, профессор РГГУ, главный редактор журнала «Религия и право», сопредседатель Славянского правового центра

- Владимир Васильевич Ряховский, адвокат, сопредседатель Славянского правового центра

- Роман Николаевич Лункин, к.ф.н., директор Института религии и права, с.н.с. ИЕ РАН

В ходе круглого стола будет всесторонне освещена проблема адекватного противодействия экстремистской деятельности, которая часто прикрывается религиозными мотивами. На практике часто возникают ситуации, когда под борьбу с экстремизмом в рамках отдельных показных кампаний подпадают вполне законопослушные верующие граждане и религиозные объединения. Ради статистики и ради того, чтобы показать видимость работы некоторые представители правоохранительных органов в регионах вмешиваются во внутренние дела религиозных объединений, лишают права арендовать помещения, издавать свою литературу, срывают богослужения. При этом, к экспертизе привлекаются люди, которые заведомо не имеют никакой религиоведческой квалификации, не разбираются в религии, и более того, враждебно относятся к той или иной конфессии или религии, которую оценивают.

Одним из последних вопиющих примеров нарушения прав верующих является откровенно абсурдный приказ Департамента по делам труда и социального развития ХМАО-Югра от 30.07.2010 (№ 05-7366/10), в котором предлагается в целях противодействия деятельности «сект» создавать добровольные дружины. К приказу прилагается список «сект», в который вошли все протестантские церкви ХМАО. Многим из них уже направили уведомления о расторжении договор аренды на помещения, где они проводят богослужения.

Другим ярким примером создания видимости борьбы с экстремизмом является ситуация, возникшая вокруг церкви пятидесятников в Благовещенске (Амурская область). Прокурор города обратился с иском в суд о признании выпуска видеоматериалов церкви незаконным, так как, по мнению «блюстителя законности», в них будто бы используются методы нейро-лингвистического программирования, которые подлежат лицензированию как медицинская деятельность. Церковь лицензии не имеет, а поэтому ее видеофильмы, к примеру, с проповедями пастора или посвященные юбилею создания церкви, могут якобы причинить вред здоровью.

В регионах есть масса такого рода случаев, когда отдельные представители правоохранительных органов делают на верующих карьеру, отрабатывают показатели отчетности, а в результате страдает престиж государства, разрушается партнерство церквей и государства и межконфессиональный мир. Борьба с верующими не имеет ничего общего с борьбой с экстремизмом.

"Countering Extremist Activity and the issue of observing citizens’ constitutional right to freedom of religion in Russia’s regions"

Among those who have been invited to participate in this roundtable discussion are representatives of the Russian Federation Presidential Administration, those units that are responsible for combating extremism in the Interior Ministry and the Prosecutor General of Russia, scientists, and representatives of religious associations from various regions of Russia where the church is facing serious challenges.

The participants and moderators of the round table will also include:

- Anatoly Pchelintsev, Professor at Russian State Humanities University, Editor-in-chief of the journal "Religion and Law", and Co-chair of the Slavic Center for Law & Justice

- Vladimir Ryakhovsky, Lawyer and Co-chair of the Slavic Center for Law & Justice

- Roman N. Lunkin, PhD (Philosophy), Director of the Institute of Religion and Law, Senior Research Fellow at the Institute of Europe, Russian Academy of Sciences

During the round table, the problem of adequately countering extremist activity will be comprehensively illuminated – a problem that is often skirted behind religious motives. In practice, there are often situations when fully law-abiding citizens among the faithful, as well as religious associations themselves, are hassled by law enforcement agencies under the guise of combating extremism within individual grandstanding campaigns carried out “just for show”. For the sake of their own statistics and to show that there is some semblance of effective law enforcement authorities in the regions, they interfere in the internal affairs of religious organizations, stripping such organizations of their right to rent premises or to publish their own literature, as well as disrupting their religious services. In this case, the people who are involved in carrying out the respective expertise obviously have no qualifications as religious experts, who are not versed in religion and, moreover, who are hostile to one or another faith or religion that happens to be under examination.

One of the recent outrageous examples of how the rights of the faithful are being violated is the plainly absurd Order from the Department for Labor and Social Development of the Ugra, Khanty-Mansiiskiy Autonomous Region, dated July 30, 2010 (Order no. 05-7366/10), in which it is proposes counteracting the activities of "sects" with respect to creating voluntary militias. Appended to this Order is a list of such "sects", among which are found all Protestant churches operating in the Khanty-Mansiiskiy Autonomous Region. As a result, many of them have already received a notice of termination of the lease they hold for the premises where they conduct their respective religious services.

Another striking example that exists in terms of creating the appearance that the authorities are actively combating extremism is the situation that arose surrounding the Pentecostal Church in the city of Blagoveshchensk (Amur Region). The city’s Prosecutor file a case against the Church in court with the request to declare the issuance of video material by the Church as illegal, since, according to "guardian of the rule of law", they seem to be using methods known as neuro-linguistic programming, which is subject to being licensed as a medically-related activity. The argument put forward by the plaintiff is that the Church does not have such a license and therefore, its movies, for example, with sermons by a pastor or events dedicated to the anniversary of the Church’s establishment, can allegedly cause harm to one’s health.

In Russia’s regions, there are many such cases where individual members of the law enforcement agencies try to advance their career at the expense of the faithful, by making themselves look good in the statistical indicators cited in their reports. However, as a result, they are inflicting serious damage to the prestige of the state and are effectively destroying the partnership existing between the church and the state, not to mention inter-religious accord within Russia. The discreet war that is being launched against the faithful has absolutely nothing to do with the struggle against extremism.
